METAPHYSICAL DIMENSIONS OF INTELLECTUAL PROPERTY IN THE FIELD OF ARTIFICIAL INTELLIGENCE

Abstract

B a c k g r o u n d . The development of artificial intelligence (AI) is radically turning traditional ideas about intellectual property upside down. Autonomous algorithms and neural networks are already capable of creating works of art, music, scientific discoveries and technological innovations, and this in turn calls into question classical approaches to understanding authorship, ownership and ethics in this area. This requires a deep philosophical analysis not only of legal aspects, but also of metaphysical, ethical foundations that determine the essence of intellectual property in the age of AI development. This study focuses on identifying the main metaphysical and individual ethical problems that arise in connection with the growing role of artificial intelligence in the process of creativity and innovation. This phenomenon not only changes the technological landscape, but also affects fundamental philosophical categories such as being, mind, creativity, etc. In the field of intellectual property, this calls into question traditional concepts of authorship, originality and ownership. There is a need to understand the metaphysical dimensions of this phenomenon, which go beyond the scope of purely legal and ethical analysis.

M e t h o d s . The study of the metaphysical and ethical dimensions of intellectual property in the field of AI is carried out on the basis of a comprehensive interdisciplinary approach that combines historical-philosophical, general scientific and special methods. In particular, historicalgenetic and comparative analysis allow us to trace the development of ideas about intellectual property and compare different philosophical approaches to authorship. The method of analysis helps to consider individual ethical and metaphysical aspects, synthesis, and also – to generalize conclusions. Induction makes it possible to identify patterns based on practice, while deduction should extend them to a broader context. This approach provides a holistic understanding of intellectual property problems in connection with the challenges posed by AI, in particular metaphysical and ethical problems.

R e s u l t s . The study revealed several key aspects. First, AI, by creating original works, forces us to reconsider the concept of authorship, since traditional law assumes the presence of a human creator. Second, the problem of responsibility becomes central. Today, the question of who owns the rights to works created by neural networks is very acute. Third, there is no single position in legal systems on this issue, as is known, some countries are already considering the possibility of amending the legislation. Regarding ethical issues, the use of AI results also raises new questions,

 

in particular regarding the impact on education, culture, the labor market, etc. The study revealed several key aspects. First, the traditional concept of authorship is based on the idea of the intentionality and self-awareness of the creator, which is not contained in AI. This forces us to rethink the very nature of the creative process. Second, the question arises of the ontological status of AI products, in other words, can they be considered independent forms of knowledge or are they only secondary products of human thinking? Third, the analysis showed that different legal systems interpret the status of such works differently, which reflects differences in philosophical approaches to understanding property and subjectivity.

C o n c l u s i o n s . The results of the study indicate the need for a fundamental revision of traditional concepts of intellectual property in the light of the development of AI. Modern theories of law and philosophy do not offer a single answer regarding the nature of creativity of neural networks. The issue of the metaphysical foundations of intellectual property is becoming increasingly relevant, requiring further research to form new conceptual approaches.
